Even Rock Stars Are Not Immune From Insurance Denials

The rock band Foo Fighters has apparently had to sue an insurance company, Lloyd’s of London, over the cancellation of several concert dates in Europe last summer – according to an article by InsuranceJournal.com. The band cancelled dates in Paris shortly after the deadly terrorist attacks there. The band was scheduled to play, but was the victim of what appeared to be very serious threats from ISIL, the Middle Eastern terrorist organization. According to the lawsuit file in California, Lloyd’s of London has refused to pay. In Florida, such a lawsuit against an insurance company is typically called a Declaratory Action. Such a lawsuit would lay out why the insured believes he is entitled to insurance coverage, and would ask a judge to declare that there is, in fact, insurance coverage for a particular loss. In Florida, under most circumstances, if an insurance company is made to admit coverage and pay a claim as the result of a Declaratory Action, the insurance company came be made to pay all of the insured’s reasonable attorneys’ fees and court costs. This kind of “fee reversal” penalty is supposed to encourage insurance companies to pay legitimate claims, and to discourage coverage denials and delays. Unfortunately, this doesn’t always work. Bar Patron Injured In Tampa Car Crash Versus Building Might Be Entitled To More Benefits Than He Realizes

An unsuspecting Tampa bar patron may be entitled to PIP benefits, bodily injury liability benefits, and even punitive damages after he was injured in an odd accident this week in a Tampa bar.   The OrlandoSentinel.com website reported about the Tampa drunk driving accident.   Apparently a woman named Sully Marie Torre–Medina lost control of her car Tuesday night, causing it to crash into the patio area of the Independent bar in Tampa.  A 34-year-old gentleman named Wesley Kincaid was apparently sitting in the bar’s patio area, was injured in a crushing injury as a result of the crash, and had to be taken to the hospital.   Mr. Kincaid may not realize it, but because he was involved in an accident arising out of the use of a motor vehicle, he may immediately be entitled to insurance benefits to pay his hospital and medical bills.  If Mr. Kincaid owns a car, he would be entitled to Personal Injury Protection (PIP) benefits under his own automobile insurance coverage.  If he doesn’t own a car, he would be entitled to PIP from Ms. Torre-Medina’s car insurance company.  (Download your FREE copy of our Florida PIP guide, by clicking here.)   Additionally, if Ms. Torre-Medina carried bodily injury coverage on her car (which is optional in Florida – but shouldn’t be), he can make a personal injury claim against her.  Because Ms. Torre-Medina has been accused of DUI, and found to be in possession of drugs and drug paraphernalia, Mr. Kincaid may also have a punitive damages claim against her.   We obviously hope that Mr. Kincaid will make a speedy recovery from his injuries.  He seems to have just been at the wrong place at the wrong time.  Nevertheless, we thought his situation was important as an illustration of all the different benefits that might be available in a Florida car accident involving a pedestrian or anyone else who is not inside a vehicle at the time of a crash.   If you have any questions following a Florida car accident of any kind, or about Florida car insurance and how it works, please call Winter Park personal injury attorneys Kim Cullen and Robert Hemphill at 407–254–4901, or visit our website.  You can also download a FREE copy of our popular Florida accident guide by clicking...

Report:  Google Car Insurance Agency on it’s way : Expect Personalized Service?

The New York Times is reporting that Google is inching closer toward opening its own automobile insurance agency.  In my opinion, another behemoth corporation like Google getting into the automobile insurance agency business really represents no improvement in terms of the lives of Florida consumers. Apparently, A Google car insurance agency is on the way. The company’s intent is to create a comparison/search website that will allow consumers to enter information about themselves, their vehicles, and their driving history and behaviors, and then received pricing or quotes from multiple insurance carriers.  As many people know, several insurance companies have their own websites set up to deliver quotes, but Google’s would presumably feature quotes from several companies.  Apparently, several Google employees have already received their insurance agent licenses in California and other states.  No word yet on whether Google has any agents in Florida, but Google is said to be focused at this point on the most populated states. The problem, as I see it, is that, while Google may have insurance agents working behind the scenes on the website, it doesn’t seem like these agents will be providing any kind of professional insurance advice to consumers.  For example, is Google going to have an employee standing by to answer consumer questions regarding the types of coverage that are available and what exactly is covered?  If you have ever tried to contact anyone at customer service at Google, you will understand that it is highly unlikely that an insurance consumer would ever be able to actually speak to a human being within the Google framework. As a Florida personal injury attorney who deals with automobile insurance matters on a daily basis, I am constantly struck by how little most Floridians understand about automobile insurance.  I am also constantly amazed at how under-insured most Floridians are in the event that some kind of unforeseen and devastating accident happens.  I have to wonder what kind of advice — if any — most Floridians are receiving from their insurance agents about available coverages, or what kind of coverage limits to buy.  I cannot imagine how the entry of Google into Florida’s insurance marketplace could possibly help consumers in this area.  Of course, I hope I turn out to be wrong.
