Grizzly Hiawassee Accident Reminds Us How Critical Uninsured Motorist Coverage Is | Orlando Accident Attorney

When I saw this video from Orlando’s Fox 35 News, I knew I needed to share it on this blog. FOX 35 News Orlando There is no doubt that when the driver of the green 2001 Ford turned on to Hiawassee Road and began heading north, the driver had no idea that there would be stolen car careening southbound on Hiawassee Road, barely under control.  The head-on collision that happened next, at the corner of Hiawassee Road and Clarcona-Ocoee Road, will likely change the Ford driver’s life forever. The damage to the cars depicted in the video is obvious.  The driver of the Ford was airlifted to Orlando Health Hospital with very serious injuries. The driver who caused the accident in the stolen Buick — is a teenager.  Because the vehicle was stolen, it is almost a certainty that there will be no liability insurance that will apply to this accident in order to satisfy the Ford driver’s damages — which will undoubtedly include thousands and thousands of dollars in medical expenses. As an Orlando accident attorney, this case highlights to me the importance of carrying Uninsured Motorist benefits as part of an auto insurance package.  If the driver of the Ford carried Uninsured Motorist coverage, that coverage will “step into the shoes” of the teenage who caused this wreck, and will provide benefits to the injured Ford driver for medical expenses, lost wages, and pain and suffering. Without Uninsured Motorist coverage, the driver of the Ford will likely recover nothing.  This is why we constantly urge people to make sure they buy Uninsured Motorist coverage, and buy as much as they can afford.  In today’s world, you just never know when an irresponsible person is going to do something to put you at risk. If you have any questions about Florida Uninsured Motorist coverage, or whether you have a legitimate Uninsured Motorist claim, call Winter Park personal injury attorneys Kim Cullen and Robert Hemphill.  Consultations are always 100% free-of-charge.  Or, order a FREE copy of Kim’s book, Asleep At The Wheel:  13 Mistakes the Insurance Company Desperately Hopes You’ll Make After Your Florida Car Accident by clicking here....

Family of Woman Killed In Crash With Stolen Vehicle Will Need To Know About UM

Family of Woman Killed In Crash With Stolen Vehicle Will Need To Know About UM

A tragedy occurred on White Street in Daytona Beach this past Saturday night. According to a story on WFTV.com, 27-year-old Laguadia Terry was killed when the vehicle she was travelling in on White Street was impacted by a stolen vehicle. The driver of the vehicle Ms. Terry was riding in, Sterling Slaton, was also seriously injured. As an Orlando accident attorney who regularly helps families with wrongful death claims, my heart goes out to Ms. Terry’s family. The death of a 27-year-old woman is tragic under any circumstances, but in this instance the men who caused this accident had apparently stolen the car, and then fled the scene. These men have not yet been brought to justice. Ms. Terry’s survivors would be well-served to consult with an experienced Central Florida car accident attorney. Even though the vehicle that crashed into Ms. Terry’s vehicle was stolen, damages might be recoverable from the Uninsured Motorist portion of a Florida automobile insurance policy. UM benefits might be available from Ms. Terry’s own coverage, from the insurance carried by Mr. Slaton, or from any resident that Ms. Terry was living with at the time of the crash. An experienced Florida auto accident lawyer will know the right questions to ask in order to determine if there is Uninsured Motorist coverage available. Any reputable personal injury firm will answer Ms. Terry’s family’s questions and perform an initial consultation absolutely...

Renewed Push To Ban Texting While Driving In Florida

Posted by on Dec 18, 2012 in Motor vehicle accidents

I was happy to read that two Florida Legislators have re-introduced legislation in Tallahassee designed to make it illegal to text while driving in Florida.  As State Senator Nancy Detert indicates, she has been trying for five (5) years to get a ban on texiting while driving passed, but has thus far been unsuccessful.  Critics of such measures regularly cite privacy concerns. The privacy argument has never made much sense to me.  Why should a texting driver’s privacy outweigh the overwhelming danger created by the distraction of texting?  According to statistics released by the State of Florida, over 25,000 Florida car accidents were caused by texting.  That number only reflects those instances where drivers admitted to texting, or where there was dependable evidence revealing texting.  In reality, it is likely that there were for more than 25,000 Florida auto crashes were texting played a role. Senator Detert, and her colleague, Senator Thad Altman, believe that public sentiment in on their side this time.  I certainly hope so. While texting drivers can currently be cited in Florida for Careless Driving, I believe that specifically making texting while driving illegal will provide an additional motivation or influence upon the behavior of drivers.  In our Florida car accident law practice, we have seen far too many cases where drivers distracted by reading or sending texts have caused horrific and life-changing injuries. I am going to keep my fingers crossed for Senators Detert and Altman and their efforts.  Call me or my partner, Robert Hemphill, at 407-254-4901, if you have any...
