Distracted Driver’s Cell Phone Pays The Price (video) | Orlando Accident Attorney

I couldn’t resist sharing this video from Russia.  Check out the driver on the left hand side of screen.  My guess is that the person who hit him failed to yield the right-0f-way and caused this crash — while on a cell phone. We obviously don’t recommend that any Florida accident victim get out of his or her car and confront another driver like this.  But I can’t say that I don’t sympathize with the victim in this video. If you have any questions regarding a Florida car accident, whether involving distracted driving or not, call Winter Park accident attorneys Kim Cullen and Robert Hemphill at...

Small Car Crash Test Results Show Room For Improvement | Orlando Accident Attorney

InsuranceJournal.com recently published the results of the Insurance Institute for Highway Safety’s (IIHS) recent crash safety testing.  In this round of testing the IIHS created a new crash test where only the front driver’s corner of the vehicle is involved.  This round of testing also only involved small cars. Here is how these small vehicles fared: GOOD 2013 Honda Civic (four-door) 2013 Honda Civic (two-door ACCEPTABLE 2013 Dodge Dart 2013 Ford Focus 2013 Hyundai Elantra 2014 Toyota Scion tC MARGINAL 2013 Chevrolet Sonic 2013 Chevrolet Cruze 2013 Volkswagen Beetle POOR 2013 Kia Soul 2014 Kia Forte 2013 Nissan Sentra Poor performers were noted to have safety cage collapses, driver airbags that moved sideways, and crash dummy occupants hitting dashboard displays during crashes. All of the companies with vehicles tested indicated that they are hard at work on new designs to improve performance on this new insurance industry test.  On the bright side, the small cars tested here generally did better than the small-sized SUV’s tested earlier this year. Based upon the results of this testing, and seeing my fair share of wrecked cars as an Orlando accident attorney, I think I’ll stick with our family’s 8-passenger Toyota Sequoia.  Clearly, if you have the means, driving a mid-sized or larger vehicle is likely to be a safer experience if you are, unfortunately, involved in a car accident. If you have any questions following a Florida car accident, call Winter Park personal injury attorneys Kim Cullen and Robert Hemphill at...

Leesburg DUI Driver Liable For Punitive Damage After Crash Death Of Passenger | Orlando Accident Attorney

The Orlando Sentinel reported the tragic death of Joseph Kauska, of Lady Lake, in a one-car, drunk driving accident near Umatilla.  Apparently, Mr. Kauska was a passenger in an SUV being driven by Chad Edmondson, who reportedly was intoxicated.  Mr. Edmondson lost control of his SUV, causing Mr. Kauska to be partially ejected, and tragically killed. In Florida, anyone injured or damaged as a result of the actions of a drunk driver are not only allowed to collect compensatory damages for the their medical bills, lost wages, and pain suffering.  Victims of drunk driving can also claim punitive damages — damages designed specifically to punish the drunk driver and provide an example to the community that drunk driving will not be tolerated. As an Orlando accident attorney who has seen his fair share of tragedy handling Florida wrongful death cases arising from drunk driving, my heart goes out to Mr. Kauska’s family.  The family would be wise to consult with an experienced Florida auto accident attorney to determine what their rights are under Florida law, and particularly the Florida Wrongful Death Act. If you have any questions regarding a Florida car accident involving a drunk driver, or questions about a claim under the Florida Wrongful Death act, call Winter Park personal injury attorneys Kim Cullen and Robert Hemphill at...
