Where Did Underage Drunk Driver Who Killed Orlando Woman Get Alcohol?
An Orlando couple who were stopped at a stoplight near Lake Buena Vista now face tragedy after they were rear-ended by a drunk driver.
The Orlando Sentinel website is reporting that Giselle Batista and Benjamin Frias were sitting at a traffic light on World Center Driver when their Toyota was rear-ended at a high rate of speed by a 20-year old man who was driving under the influence. Ms. Batista was tragically killed in the crash, while Mr. Frias was critically injured.
It is my understanding that the 20-year old who caused the accident is justifiably facing vehicular manslaughter charges.
Setting aside for a moment the tragedy faced by the Batista and Frias families, and our sympathies for what they must be going through, as an Orlando car accident attorney, the fact that the drunk driver was underage gives me reason to ask, “Where did he get enough alcohol to get that drunk?”
Under Florida law if a bar or nightclub served this 20-year alcohol, the bar or nightclub could be held liable, in addition to any liability faced by the driver, himself, or the owner of the vehicle he was driving. It will be interesting to see how this story unfolds.
